  1. GENERAL PROVISIONS

  2. The range of services offered by sfondo. is aimed at people (customers) worldwide.

  3. These General Terms and Conditions (hereinafter: “GTC”) apply to all contracts between the CUSTOMER and sfondo.

    Conclusion of contract

  4. With the presentation of the products in the sfondo. Online shop has sfondo. no binding offer. When purchasing via sfondo. In the online shop, the offer to conclude a contract is made by the CUSTOMER by clicking the “Send order” button after completing the order page. By submitting the offer, the CUSTOMER refers to these General Terms and Conditions and accepts them.

  5. The automated email from sfondo. following the dispatch of the order, which confirms receipt of the order, does not constitute acceptance.

  6. As a declaration of acceptance from sfondo. This applies to the delivery of a confirmation email to the CUSTOMER, the shipping confirmation or, at the latest, the delivery of the ordered goods.

  7. All prices for services from sfondo. are net in Swiss francs (CHF) excluding VAT

    Delivery

  8. Delivery is made to the delivery address and contact person specified by the CUSTOMER in the ordering process.

  9. The delivery is subject to proper self-delivery by sfondo's suppliers. In the event of force majeure, such as strikes, other industrial action, riots, war, natural disasters or a delivery block by the upstream supplier or manufacturer, no delay in delivery will occur.

  10. If not all ordered goods are in stock, sfondo. entitled to partial deliveries.

  11. The goods have a delivery time of 14-18 days after payment.

    Transfer of risk

  12. Sfondo. fulfilled with handover to the transport person. After dispatch, the risk passes to the customer. Sfondo. is not responsible for any negligence on the part of the transport person. In the case of work services, the risk passes to the CUSTOMER upon delivery; in the event of default in acceptance, the risk passes to the CUSTOMER at the time the default occurs.

    Warranty and withdrawal

  13. The CUSTOMER must inspect the delivered goods as soon as possible in the normal course of business and immediately report any defects. display. Obvious transport damage must be recorded on the delivery documents and sfondo. and the transport person must be communicated immediately in writing. Hidden defects must be reported immediately after they are discovered. Otherwise, the delivered goods are considered approved.

  14. Sfondo. provides warranty by rectifying defects, at sfondo's discretion. either through repair or replacement delivery. Replaced products become the property of sfondo. transferred. It says sfondo. In this case, you are also free to cancel the contract. The CUSTOMER only has the right to withdraw in the event of significant defects and simultaneous failure of repair or subsequent delivery. Otherwise, the CUSTOMER has no right of withdrawal, regardless of the legal reason.

  17. The collection and processing of the CUSTOMER's personal data by sfondo. is based on the data protection declaration, which forms an integral part of these general terms and conditions.

  18. Severability clause and reservation of changes

  19. Should individual provisions of these General Terms and Conditions be ineffective or incomplete or should fulfillment become impossible, this will not affect the effectiveness of the remaining provisions. The contractual partners undertake to replace the invalid provision with a permissible, effective provision whose content comes closest to the original intention and the economic purpose pursued.

  20. All changes or additions to these General Terms and Conditions require a form that allows proof in text, such as letters and e-mails. This also applies to a change to the written form requirement. As soon as the CUSTOMER receives services from sfondo after the change. he implicitly agrees to the new terms and conditions.

  21. Different contractual conditions of the customer, namely those which the CUSTOMER declares to be applicable when accepting the contract, do not become part of the contract. They are only valid if and to the extent that they are approved by sfondo. have been expressly accepted in written form.

    Applicable Law and Jurisdiction

  22. Swiss law applies exclusively, excluding the provisions of the United Nations Convention on Contracts for the International Sale of Goods. Sfondo. is also entitled to sue at the CUSTOMER's place of residence or at another legal place of jurisdiction. In the event of disputes arising from consumer contracts, Sfondo applies to claims. the CUSTOMER's place of residence as the place of jurisdiction, in the case of the CUSTOMER's lawsuits, the place of residence or registered office of one of the parties.
